Pura Scents, Inc. – Pre-Black Friday Giveaway Official Rules
These are the official rules (“Rules”) that govern your participation in the Pura Pre-Black Friday promotion (“Giveaway”).
- No Purchase Necessary. NO PURCHASE OR PAYMENT OF ANY MONEY IS NECESSARY TO PARTICIPATE IN GIVEAWAY. VOID WHERE PROHIBITED.
- Sponsor. Sponsor of this promotion is Pura Scents, Inc., 2100 Pleasant Grove Boulevard, Suite 600, Pleasant Grove, UT 84062 (“Sponsor”).
- Giveaway Period. This Giveaway begins at 12:01 AM United States Mountain Time (“MT”) on November 19, 2021 and ends at 11:59 PM MT on November 19, 2021 (the “Giveaway Period”). Sponsor’s computer is the official time-keeping device. All entries must be submitted and received during the Giveaway Period. Odds of winning depend on the number and timing of entries submitted during the Giveaway Period.
- Eligibility. The Giveaway is only offered to natural persons who are (i) U.S. legal residents currently residing in the U.S.; and (ii) at least the age of 18 years old and the age of majority in their jurisdiction of residence. Participation is limited to individuals who would not violate their employer policies by entering or receiving the prize, and by entering participant represents that he or she is complying with his or her employer’s terms and conditions. Employees of Sponsor and its parent and affiliate companies as well as the immediate family (spouse, parents, siblings and children) and household members of each such employee are not eligible. Sponsor reserves the right to cancel, amend or close the Giveaway at any time.
- How to Enter. To be eligible for a potential prize, participant must, during the Giveaway Period, enter through completing a product purchase via Sponsor’s website during the Giveaway Period (“Purchase”) or via email by following the instructions below (each an “Entry”).

- Entering through Purchase. To enter through a Purchase, a participant must complete a Purchase.
- Entering via Email. A participant may also receive an entry by emailing with “Enter me in the Pura Pre-Black Friday Giveaway” in the subject line and including his or her name, phone number, address and email address in the body of the email to: promo@pura.co. Email entries must be sent to and received by Sponsor during the Giveaway Period. One entry per email.
- Maximum of one entry regardless of entry method.
- Qualification. A participant is only eligible for one prize. Multiple participants are not permitted to share the same email or other account needed for participation. Any attempt by any participant to obtain more than the stated number of entries by using multiple/different email addresses, Instagram Accounts, identities, registrations and logins, or any other methods will void that participant’s entries and that participant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Each potential winner may be required to show proof of being the authorized account holder. Sponsor will have the right to determine the identity of the participant(s) and timing of entries in its sole discretion.
- Prize. There will be one (1) winner. The winner will receive three Pura Party Boxes. The aggregate retail value of the prizes is approximately $1150. No substitution, assignment or transfer of the prize is permitted, except by Sponsor, who has the right to substitute a prize with another of comparable or greater value. Winner is responsible for all other taxes, charges and fees associated with the receipt and/or use of the prize.
- Determining Winner. Winner will be selected in a random drawing on or about November 29, 2021. Sponsor will notify winner from or via email address associated with the Winning Entry with instructions on how to redeem their prize within the time frame designated by Sponsor. Sponsor is not responsible for any delay or failure to receive notification for any reason, including inactive account(s), technical difficulties associated therewith, or winner’s failure to adequately monitor any account. Winner must then respond to Sponsor within five calendar days. Should a winner fail to respond to Sponsor, Sponsor reserves the right to disqualify that winner and select a new one. Winner may be required to sign an affidavit of eligibility, liability release, and a publicity release. By entering or accepting any prize, winner allows Sponsor to use the winner’s name, photograph, likeness, voice, prize information, and biographical information for publicity and promotional purposes without further compensation where permitted by law. Except where prohibited, participation constitutes participant’s consent to Sponsor’s use of participant’s name, likeness, voice, opinions, biographical information, hometown and state for promotional purposes in any media without further payment or consideration.
- Conditions of Participation. By participating, participant agrees to abide by these Rules and any decision Sponsor makes regarding this promotion (including awarding of any prize), which Sponsor shall make in its sole discretion. Sponsor reserves the right to disqualify and prosecute to the fullest extent permitted by law any participant or winner who, in Sponsor’s reasonable suspicion, tampers the entry or Giveaway process, intentionally submits more than one entry, violates these terms and conditions, or acts in an unsportsmanlike or disruptive manner.
- Disqualification and Termination. Participants found engaging in any of the following activities may be disqualified and ineligible for any prize: (a) tampering with, disrupting, or attempting to disrupt, or any unauthorized use, misuse or abuse of any aspect of an entry or Giveaway; (b) violating any applicable law; (c) allowing any unauthorized person to use your email address or other account related to a Giveaway or entry; (d) attempting to perpetuate fraud on the Giveaway through multiple entries for the same Giveaway, false identification or email addresses, false registration, false impersonation or any other means; (e) failing to provide complete and accurate information required for payment of incentives and/or tax reporting purposes; or (f) for any other breach of these Rules. Termination for any of these reasons may also subject participant to civil and criminal penalties and may result in legal action. Sponsor may invalidate an Entry if the participant does not meet eligibility requirements.
- Disclaimer, Release and Limit of Liability. SPONSOR MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY PRIZE OR YOUR PARTICIPATION IN THE GIVEAWAY. BY PARTICIPATING IN THE GIVEAWAY OR RECEIPT OF ANY PRIZE, EACH PARTICIPANT AGREES TO RELEASE AND HOLD HARMLESS SPONSOR, AND ITS RESPECTIVE SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS, ADVERTISING/PROMOTION AGENCIES, AND PRIZE SUPPLIERS, AND EACH OF THEIR RESPECTIVE PARENT COMPANIES AND EACH SUCH COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”) FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, DEATH, OR DAMAGE TO OR LOSS OF PROPERTY, ARISING OUT OF PARTICIPATION IN THE GIVEAWAY OR RECEIPT OR USE OR MISUSE OF ANY PRIZE. THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR: (A) ANY INCORRECT OR INACCURATE INFORMATION, WHETHER CAUSED BY PARTICIPANTS, PRINTING ERRORS OR BY ANY OF THE EQUIPMENT OR PROGRAMMING ASSOCIATED WITH OR UTILIZED IN THE GIVEAWAY; (B) TECHNICAL FAILURES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO MALFUNCTIONS, INTERRUPTIONS, OR DISCONNECTIONS IN PHONE LINES OR NETWORK HARDWARE OR SOFTWARE; (C) UNAUTHORIZED HUMAN INTERVENTION IN ANY PART OF THE GIVEAWAY; (D) TECHNICAL OR HUMAN ERROR WHICH MAY OCCUR IN THE ADMINISTRATION OF THE GIVEAWAY; OR (E) ANY INJURY OR DAMAGE TO PERSONS OR PROPERTY WHICH MAY BE CAUSED, DIRECTLY OR INDIRECTLY, IN WHOLE OR IN PART, FROM PARTICIPANT’S PARTICIPATION IN THE GIVEAWAY OR RECEIPT OR USE OR MISUSE OF ANY PRIZE. If for any reason a participant’s Giveaway is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, participant’s sole remedy is another entry in the Giveaway, provided that if it is not possible to award another entry due to discontinuance of the Giveaway, or any part of it, for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all participants up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes will be awarded. In event that production, technical, programming or any other reasons cause more than stated number of prizes as set forth in these Rules to be available and/or claimed Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, unawarded, eligible prize claims. Sponsor reserves the right to cancel, amend or suspend the Giveaway at any time, with or without prior notice, including if the Giveaway encounters any unexpected problems.
- Privacy and Use of Giveaway Information. Sponsor collects personal information from you when you enter this promotion. Sponsor reserves the right to use any information collected in accordance with its privacy policy, which may be found at <trypura.com/pages/privacy-policy>.
- GOVERNING LAW AND DISPUTES. THESE RULES AND THE GIVEAWAY ARE GOVERNED BY, AND WILL BE CONSTRUED IN ACCORDANCE WITH,
- THE LAWS OF THE STATE OF UTAH AND THE UNITED STATES AND THE FORUM AND VENUE FOR ANY DISPUTE ARISING OUT OF OR RELATING TO THESE OFFICIAL RULES SHALL BE IN SALT LAKE COUNTY, UTAH. IF THE CONTROVERSY OR CLAIM IS NOT OTHERWISE RESOLVED THROUGH DIRECT DISCUSSIONS OR MEDIATION, IT SHALL THEN BE RESOLVED BY FINAL AND BINDING ARBITRATION ADMINISTERED BY JUDICIAL ARBITRATION AND MEDIATION SERVICES, INC., IN ACCORDANCE WITH ITS STREAMLINED ARBITRATION RULES AND PROCEDURES OR SUBSEQUENT VERSIONS THEREOF (“JAMS RULES”). THE JAMS RULES FOR SELECTION OF AN ARBITRATOR SHALL BE FOLLOWED, EXCEPT THAT THE ARBITRATOR SHALL BE EXPERIENCED AND LICENSED TO PRACTICE LAW IN UTAH. ANY SUCH CONTROVERSY OR CLAIM WILL BE ARBITRATED ON AN INDIVIDUAL BASIS, AND WILL NOT BE CONSOLIDATED IN ANY ARBITRATION WITH ANY CLAIM OR CONTROVERSY OF ANY OTHER PARTY. ALL PROCEEDINGS BROUGHT PURSUANT TO THIS PARAGRAPH WILL BE CONDUCTED IN UTAH, UNITED STATES. THE REMEDY FOR ANY CLAIM SHALL BE LIMITED TO ACTUAL DAMAGES, AND IN NO EVENT SHALL ANY PARTY BE ENTITLED TO RECOVER PUNITIVE, EXEMPLARY, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING ATTORNEY’S FEES OR OTHER SUCH RELATED COSTS OF BRINGING A CLAIM, OR TO RESCIND THIS AGREEMENT OR SEEK INJUNCTIVE OR ANY OTHER EQUITABLE RELIEF.
- Winner List. Individuals may request the name of winner by submitting a self-addressed stamped envelope prior to February 28, 2022 to Pura Scents, Inc., 2100 Pleasant Grove Boulevard, Suite 600, Pleasant Grove, UT 84062.
